NOTICE OF TRUSTEE'S SALE The following property will be sold to the highest bidder at a public auction at the time of sale at the front entrance of the Box Elder First Judicial District Courthouse, 43 N. Main, Brigham City, Utah, on December 9, 2013 at 12:15 p.m., to foreclose a Trust Deed recorded December 27, 1999 as Entry No. 136413, executed by Chris Dietz and Stephenie Dietz, as Trustors, in favor of Zions Mortgage Company, covering real property in Box Elder County (Tax/Parcel No. 03-072- 0010) purportedly, but not guaranteed to be located at 3740 W. 2400 N., Corinne, UT 84307, together with, and subject to, any applicable improvements, fixtures, easements, appurtenances, taxes, assessments, conditions, covenants, restrictions, reservations or other enforceable rights and obligations, and described as follows: A part of the North half of the Northeast Quarter of Section 6, Township 9 North, Range 2 West of the Salt Lake Base and Meridian. Beginning at a point located West 1203.53 feet along the North line of said Northeast Quarter and South 425.13 feet from the Northeast Corner of said Northeast Quarter, said point being on the Southerly railroad right-of-way line; running thence South 68°39'14" East 98.60 feet along said right-of-way line; thence South 21°10'23" West 151.61 feet; thence North 68°30'00" West 192.38 feet (191.95 feet record); thence North 18°45'26" East 20.32 feet; thence South 68°30'00" East 100.54 feet; thence North 18°35'39" East 131.22 feet to the point of beginning. The current beneficiary of the Trust Deed is Bank of America, N.A. and as of the date the Notice of Default recorded, the property was owned by Chris Dietz and Stephenie Dietz according to record. The successful bidder must tender a $5,000 non-refundable deposit at the sale, in the form of a cashier's/official bank check payable to the Trustee, and deliver the balance in certified funds to the Trustee's office within 24 hours of the sale; otherwise, the Trustee reserves the right to sell the property to the next highest bidder, retain the deposit, and hold the defaulting bidder liable for any additional damages. The sale is without any warranty, including title, possession and encumbrance, and is voidable by the Trustee, without any liability, for any circumstance unknown to the Trustee affecting the validity of the sale. If the Trustee voids the sale, the successful bidder's sole remedy is return of any funds tendered to the Trustee.
