AMENDED NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Tooele County Courthouse, 74 South 100 East, Tooele, Utah, on April 1, 2014, at 8:30 a.m. of said day, for the purpose of foreclosing a trust deed dated October 22, 2009 and executed by Bart J. Warden, as trustor, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for New American Funding, A California Corporation, its successors and assigns, covering the following real property purported to be located in Tooele County at 1082 South 860 West, Tooele, UT 84074 (the undersigned disclaims liability for any error in the address), and more particularly described as: All of Lot 4096, Rancho Tooele Phase IV Amended, according to the official plat thereof on file and of record in the Tooele County Recorder's Office. Being the same property as described in deed doc #313996, dated 09/17/08, recorded 09/18/08 in Tooele County records. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 11-049-0-4096 The current beneficiary of the trust deed is Nationstar Mortgage, LLC and the record owner of the property as of the recording of the notice of default is Cassaundra Freeman. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check, payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. A bank or credit union cashier's check must be pre-printed and clearly state that it is a cashier's check. A bank official check must be pre-printed and clearly state that it is an official check. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
