NOTICE OF TRUSTEE'S SALE (Tax Parcel Nos. 15-28-354-042-0000 and 15-28-354-043-0000) The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, inside the rotunda in the east entrance to the Third Judicial District Court, Salt Lake City District, Salt Lake County located at 450 South State Street, Salt Lake City, Utah on February 27, 2014 at 9:00 a.m. of said day for the purpose of foreclosing a Deed of Trust, and Assignment of Leases and Rents ("Trust Deed"), executed by 3090-3500, LLC as Trustor ("Trustor"), in favor of Wells Fargo Bank, National Association, as Beneficiary ("Wells Fargo"). The Trust Deed was recorded February 20, 2008, as Entry No. 10352011, Book 9571, Pages 9656-9673 in the official records of Salt Lake County, Utah. A Substitution of Trustee appointing Sherilyn A. Olsen, Esq., of HOLLAND & HART LLP, 222 South Main Street, Suite 2200, Salt Lake City, UT 84101, as Successor Trustee ("Trustee") was recorded April 1, 2013 as Entry No. 11609308 in the official records of Salt Lake County, Utah. A Notice of Default and Election to Sell ("Default Notice") was recorded in the official records of Salt Lake County Utah on October 16, 2013 as Entry No. 11742587. Trustee will sell at public auction to the highest bidder the real property located in Salt Lake County, State of Utah, described as (the "Property"): PARCEL 1: Beginning 100 feet West from the Southeast corner of Lot 8, WESTBROOK ESTATES; thence West 25 feet; thence South 125 feet to North line of 3500 South Street; thence East 25 feet; thence North 125 feet to point of beginning. PARCEL 2: Beginning 50 feet West from the Southeast corner of Lot 8, WESTBROOK ESTATES; thence West 50 feet; thence South 15 feet to North line of 3500 South Street; thence East 50 feet; thence North 125 feet to the point of beginning Less and except from Parcels 1 and 2 above that portion conveyed to Utah Department of Transportation by Warranty Deed recorded May 14, 2008 as Entry No. 10427571 in Book 9606 at Page 5485 of Official Records, more particularly described as: A parcel of land in fee, being part of an entire tract of property situate in the Southwest quarter of the Southwest quarter of Section 28, Township 1 South, Range 1 West, Salt Lake Base and Meridian, described as follows: Beginning at the Southwest corner of said entire tract in the Northerly right of way line of the existing highway State Route 171 which corner is 577.32 feet East and 33.00 feet North 00°01'15" East from the Southwest corner of said Section 28, said corner is also 100.20 feet (100 feet by record) West and 125.00 feet South 00°01'15" West (South by record) and 25.00 feet West from the Southeast corner of Lot 8, WESTBROOK ESTATES SUBDIVISION, said corner is also approximately 50.32 feet perpendicularly distant Northerly from the control line of said project opposite engineer station 704+69.85; and running thence North 00°01'15" East (North by record) 19.04 feet along the Westerly boundary line of said entire tract to a point 69.36 feet perpendicularly distant Northerly from said control line; thence East 75.03 feet along a line parallel with and S2.04 feet perpendicularly distant Northerly from the Southerly section line of said section to a point in the Easterly boundary line of said entire tract which point is 69.36 feet perpendicularly distant Northerly from said control line; thence South 00°06'40" West (South by record) 19.04 feet along said Easterly boundary line to the Southeast corner of said entire tract; thence West 75.00 feet along said Northerly right of way line to the point of beginning. The Property is also known by the street address of 3090 West 3500 South, West Valley City, Utah 84119. The current Beneficiary of the Trust Deed is Wells Fargo, whose address is 299 South Main Street, 11th Floor, Salt Lake City, Utah 84111. The record owner of the Property as of the recording of the Default Notice is 3090-3500, LLC. The Trustee's sale will be made without warranty as to title, possession, encumbrances, condition of the Property or any other matter. Bidders at the Trustee's sale must be prepared to tender a $10,000.00 non-refundable deposit to the Trustee, and the balance of the purchase price must be tendered to the Trustee within 48 hours of the sale. Both the deposit and the balance must be in immediately available funds by cashier's check or wire, payable to Holland & Hart LLP's Trust Account. A Trustee's Deed will be delivered to the successful bidder within three business days of receipt of the amount bid. The sale is subject to a workout, reinstatement, payoff, or other condition that would cause the cancellation of the sale (the "Conditions"). Further, if any of these Conditions exist, the sale will be void and the successful bidder's funds will be returned, and the Trustee and the Beneficiary shall not be liable to the successful bidder for any damages.
