NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the East Main Entrance, Weber County Second District Courthouse, 2525 Grant Ave., Ogden, Utah, on February 20, 2014 at 11:30 AM, for the purpose of foreclosing a Trust Deed dated May 22, 2009 executed by Jody Brimhall, as Trustor, in favor of Mortgage Electronic Registration Systems, Inc., as Beneficiary, covering real property located in Weber County and described as follows: PARCEL 1: LOT NO. 68, CONTAINED WITHIN THE GOLFCREST VILLAGE TOWNHOMES SUBDIVISION PHASE 1, THE SAME AS IDENTIFIED IN THE PLAT RECORDED AS ENTRY NO. 1718484 IN BOOK 52 AT PAGE 68, AND IN THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTION OF THE GOLFCREST VILLAGE TOWNHOMES SUBDIVISION PHASE 1 RECORDED AS ENTRY NO. 1786003 IN BOOK 2157 AT PAGE 112 OF THE OFFICIAL RECORDS OF THE WEBER COUNTY RECORDER, STATE OF UTAH. TOGETHER WITH A RIGHT AND EASEMENT OF USE AND ENJOYMENT IN AND TO THE OPEN SPACE AREAS AND EASEMENTS DESCRIBED AND PROVIDED FOR IN SAID DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS AND IN THE RECORD OF SURVEY MAP IN THE OFFICIAL RECORD OF THE WEBER COUNTY RECORDER. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Tax Parcel No.: 17-251-0024 The street address of the property is purported to be 392 West 1925 North, Harrisville, UT 84414. The undersigned disclaims any liability for any error in the street address. The current Beneficiary of the trust deed is Bank of America, N.A. and the record owners of the property as of the recording of this notice of default is reported to be Jody Brimhall. Bidders must be prepared to tender to the Trustee $10,000.00 in the form of a cashier's check or money order(s) at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The balance may be in the form of a cashier's check, money order(s), or wire transfer. Cash and bank official checks are not acceptable. A trustee's deed will be made available to the successful bidder within three business days following receipt of the bid amount. Receipt of the bid amount being defined as the date tendered funds "clear" the Trustee's trust account. The sale is made without any warranty whatsoever, including but not limited to any warranty as to title, liens, possession, taxes, encumbrances, or condition of the property. The sale is subject to a workout reinstatement, payoff, sale cancellation or postponement, incorrect bidding instructions, bankruptcy, or any other circumstance of which the Trustee is unaware. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, the Mortgagee's attorney, or the Trustee.
