AMENDED NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Sevier County Justice Complex, 835 East 300 North, Suite 100, Richfield, Utah, on February 10, 2014, at 1:00 p.m. of said day, for the purpose of foreclosing a trust deed dated December 17, 2007 and executed by Ken Castles and Sandra Castles, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Countrywide Bank, FSB., its successors and assigns, covering the following real property purported to be located in Sevier County at 45 East 300 North, and 57 East 300 North, Monroe, UT 84754 (the undersigned disclaims liability for any error in the address), and more particularly described as: The East half of Lot 2, Block 60, Plat "A", Monroe City Survey. Excepting therefrom that portion lying within canal right of way. Now known as: Parcel 1: Beginning 132 feet East of the Southwest corner of Lot 2, Block 60, Plat 'A', Monroe City Survey; thence North along the East line of Tax Serial No. 1-M23-43, 137.26 feet, more or less to the South line of Tax Serial No. 1-M23-52; thence South 89°46'02" East 102 feet; thence South 0°13'58" West 137.26 feet, more or less to South line of Lot 2; thence West 102 feet, more or less to beginning. Parcel 2: Beginning South 89°46'02" East 234 feet along Block line from the Southwest corner of Lot 2, Block 60, Plat 'A', Monroe City Survey; thence North 0°13'58" East 137.26 feet; thence North 89°46'02" West 102 feet; thence North 0°13'58" East 126.74 feet to the North line of Lot 2; thence South 89°46'02" East along said North Lot line 132 feet to the Northeast corner of Lot 2; thence South 0°13'58" West along East line of said Lot 2, 264 feet to the Southeast corner of Lot 2; thence North 89°46'02" West along South line of Lot 2, 30 feet to beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 1-M23-42-Parcel 1 and 1-M23-52-Parcel 2 The current beneficiary of the trust deed is Green Tree Servicing LLC and the record owners of the property as of the recording of the notice of default are Ken Castles and Sandra Castles. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check, payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. A bank or credit union cashier's check must be pre-printed and clearly state that it is a cashier's check. A bank official check must be pre-printed and clearly state that it is an official check. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
