NOTICE OF TRUSTEE'S SALE NOTICE IS HEREBY GIVEN that the following described real property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of the sale, Monday, September 30, 2013, at 12:00 p.m., at the front entrance of the Sanpete County Courthouse, located at 50 South Main Street, Manti, Utah, for the purpose of foreclosing that certain Deed of Trust executed by MANTI HOUSE PROPERTIES, LLC, as Trustor, in favor of ZIONS FIRST NATIONAL BANK, as Trustee, and ZIONS FIRST NATIONAL BANK, as Beneficiary, recorded May 14, 2007, as Entry No. 145455, in Book 549, at Page 1349, of the Official Records of Sanpete County, State of Utah, as modified pursuant to that certain Modification of Deed of Trust dated April 4, 2008, and filed for record April 8, 2008 as Entry No. 153836, in Book 568, at Page 315 of the Official Records of Sanpete County, State of Utah (the "Deed of Trust"). The Deed of Trust covers the following real property purported to be located in Sanpete County at 401 North Main Street, Manti, UT 84642 (the undersigned disclaims liability for any error in the address), and more particularly described as: BEGINNING AT THE SOUTHEAST CORNER OF BLOCK 105, PLAT "A", MANTI CITY SURVEY; THENCE NORTH 96 FEET; THENCE WEST 13 RODS; THENCE SOUTH 96 FEET; THENCE EAST 13 RODS TO THE POINT OF BEGINNING Tax Id No. 1749 The current beneficiary of the Deed of Trust is ZIONS FIRST NATIONAL BANK, and the record owner of the property as of the recording of the notice of default is MANTI HOUSE PROPERTIES LLC. PLEASE TAKE FURTHER NOTICE that bidders must tender to the trustee a Five Thousand Dollars ($5,000.00) deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a cashier's check or bank official check payable to Jones Waldo Holbrook & McDonough. The balance must be in the form of a wire transfer, cashier's check, bank official check (credit union official checks are not accepted) or U.S. Postal money order payable to Jones Waldo Holbrook & McDonough. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within five business days after receipt of the amount bid. The sale will be made without covenant or warranty, express or implied, regarding title, possession or encumbrances. This Trustee's Sale is subject to a bankruptcy filing, a payoff, a reinstatement or any other condition of which the trustee is not aware that would cause the cancellation of this sale. Further, if any of these conditions exist, this sale will be null and void, the successful bidder's funds shall be returned, and the Trustee and the Beneficiary shall not be liable to the successful bidder for any damages.
