Notice of Trustee's Sale The following property will be sold at public auction to the highest bidder without warranty, at the South Main Entrance, Fourth Judicial District, American Fork Division, 75 East 80 North, American Fork, Utah, on 9/24/13 at 08:30 AM, for the purpose of foreclosing a Trust Deed executed by Shauna Binkerd, as Trustor, in favor of Mortgage Electronic Registration Systems, Inc. as nominee for Lehman Brothers Bank, FSB, a Federal Savings Bank, its successors and assigns, recorded on 7/26/05, as Entry # 80514:2005, covering real property purportedly known as 749 North 150 East, Springville, UT 84663, and more particularly described as: Unit 5 as identified in Official Plat of PHASE 1, THE WILLOWS OF SPRINGVILLE, a Planned Unit Development, Springville, Utah County, Utah, recorded in the Office of the Utah County Recorder as Entry No.75248:2002, subject to the Declaration of Protective Easements, Covenants, Conditions and Restrictions of The Willows of Springville, a Planned Unit Development, recorded in the office of the Utah County Recorder, as Entry No. 75249:2002 (as said Declaration may have heretofore been amended or supplemented). Together with a right and easement of use and enjoyment in and to the Common Areas described, as provided for, in said Declaration of Protective Easements, Covenants, Conditions and Restrictions (as said Declaration may have heretofore been amended or supplemented). THE LEGAL DESCRIPTION OF SAID PROPERTY WAS CORRECTED BY AFFIDAVIT RECORDED AUGUST 16, 2005 AS ENTRY NO. 69766:2005, AS FOLLOWS: Unit 5 as identified in Official Plat of PHASE 1, AMENDED THE WILLOWS OF SPRINGVILLE, a Planned Unit Development, Springville, Utah County, Utah, recorded in the Office of the Utah County Recorder as Entry No.75248:2002, subject to the Declaration of Protective Easements, Covenants, Conditions and Restrictions of The Willows of Springville, a Planned Unit Development, recorded in the office of the Utah County Recorder, as Entry No. 75249:2002 (as said Declaration may have heretofore been amended or supplemented). Together with a right and easement of use and enjoyment in and to the Common Areas described, as provided for, in said Declaration of Protective Easements, Covenants, Conditions and Restrictions (as said Declaration may have heretofore been amended or supplemented). TAX # 55:622:0005. Nationstar Mortgage LLC is the current Beneficiary of the Trust Deed. Record owners of the property as of the recording of the Notice of Default are reported to be Douglas Binkerd and Shauna L. Binkerd. Highest bidder must tender to Trustee a $20,000 deposit in certified funds/cashier's check at time of sale. Deposit is non-refundable and retained as damages if balance not paid within 24 hours of sale. Trustee disclaims liability for any error in the street address shown herein. Trustee may void sale due to any unknown facts at time of sale that would cause the cancellation of the sale. If sale is voided, Trustee shall return funds to bidder, and the Trustee and Beneficiary shall not be liable to bidder for any damages.
