NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the Rich County Courthouse, 20 South Main Street, Randolph, Utah on September 20, 2013 at 2:00 p.m. of said day, for the purpose of foreclosing a homeowners association lien against Cache Valley Bank as owner, in favor of Swan Creek Village Homeowners Association, covering real property located at 1367 N. Sculpin Loop, Garden City, UT 84028 and more particularly described as: LEGAL DESCRIPTION: Lot 7, block 1 EL LCO Terrace subdivision Parcel ID No. 41-08-03-007 Record owner of the property as of the recording of the Notice of Default is Cache Valley Bank. The sale is subject to a bankruptcy filing, a payoff, or any other condition of which the Trustee is not aware that would cause the cancellation of the sale. If any such condition exists, the sale shall be void, the successful bidder's funds returned and the Trustee and Association shall not be liable to the successful bidder for any damage. The sale will be made without covenant or warranty, express or implied, regarding title, possession or encumbrances. Bidders must tender to the Trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 5:00 p.m. the day following the sale. The deposit and purchase price must be in the form of a cashier's check, bank official check, or U.S. Postal money order payable to Richards Kimble & Winn, PC.
