Notice of Trustee's Sale The following property will be sold at public auction to the highest bidder without warranty, at the East main entrance of the Tooele Courts Complex, 74 South 100 East, Tooele, Utah, on 9/16/13 at 04:30 PM, for the purpose of foreclosing a Trust Deed executed by Kenneth Nathan Gardner and Michelle T. Gardner, as Trustors, in favor of Mortgage Electronic Registration Systems, Inc., recorded on 6/7/07, as Entry # 286215, covering real property purportedly known as 1673 North Aaron Drive, Tooele, UT 84074, and more particularly described as: Unit No. 4 of COMISKEY PARK GARDEN HOMES CONDOMINIUMS PHASE 1, together with all improvements located thereon, as said Unit is identified in the Plat of said Development Recorded August 13, 2004 as Entry No. 227595 in Book 963 at Page 788 of the Official records of the Tooele County Recorder, State of Utah: and as identified and described in the Declaration of Condominium of Comiskey Park Garden Homes Condominiums, an Expandable Condominium Project. Recorded August 13, 2004 as Entry No. 227596 in Book 963 at Page 790 of the Official Records of the Tooele County Recorder, State of Utah. Together with an undivided interest, and a right and easement of use and enjoyment in and to the common areas described, as provided for and in the percentage shown in said Declaration. SUBJECT to the provisions of said Declaration, including any amendments thereto, and subject to modification, from time to time, as provided in the Declaration for Expansion of the Condominium Project. TAX # 15-014-0-0004. Nationstar Mortgage, LLC is the current Beneficiary of the Trust Deed. Record owners of the property as of the recording of the Notice of Default are reported to be Kenneth Nathan Gardner and Michelle T. Gardner. Highest bidder must tender to Trustee a $20,000 deposit in certified funds/cashier's check at time of sale. Deposit is non-refundable and retained as damages if balance not paid within 24 hours of sale. Trustee disclaims liability for any error in the street address shown herein. Trustee may void sale due to any unknown facts at time of sale that would cause the cancellation of the sale. If sale is voided, Trustee shall return funds to bidder, and the Trustee and Beneficiary shall not be liable to bidder for any damages.
