NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the South Main Entrance, 206 West Tabernacle, St. George, Utah, on September 3, 2013, at 10:00 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on July 26, 2007 by Suzan D. Hanks, as trustor, in favor of Wells Fargo Bank, N.A., covering the following real property purported to be located in Washington County at 434 West 100 North, Hurricane, UT 84737 (the undersigned disclaims liability for any error in the address), and more particularly described as: Beginning at a point two(2) rods North of the Southeast corner of the Southwest Quarter of the Northeast Quarter (SW 1/4 NE 1/4) of Section 34, Township 41 South, Range 13 West, Salt Lake Base and Meridian, and running thence West 46.5 feet; thence North 82.5 fe feet; thence East 46.5 feet; thence South 82.5 feet to the point of beginning Less and Excepting: Commencing at the Southeast Corner of the Southwest quarter of the Northeast quarter of Section 34, Township 41 South, Range 13 West, Salt Lake Base and Meridian; thence North 00°54'07" East 33.00 feet along the Center Section line to Southeast corner of grantor's land as recorded #20060010141, Washington County Official Records, and the point of beginning; thence North 89°01'03" West 46.50 feet to a point on the West line of said parcel; thence North 00°54'07" East 9.48 feet along said West line; thence South 89°01'16" East 46.50 feet to a point on the East line of said parcel; thence South 00°54'07" West 9.48 feet to the point of beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: H-331-C The current beneficiary of the trust deed is Wells Fargo Bank, N.A. and the record owners of the property as of the recording of the notice of default are Hurricane City and Suzan D. Hanks. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
