AMENDED NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the South Entrance, Cedar City Hall of Justice, 40 North 100 East, Cedar City, Utah, on August 20, 2013, at 12:00 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on December 20, 2006 by Tracy Todd Talbot and Leah Dawn Talbot, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Utah Financial, Inc., its successors and assigns, covering the following real property purported to be located in Iron County at 5255 West 6600 North, Cedar City, UT 84720 (the undersigned disclaims liability for any error in the address), and more particularly described as: Parcel No. 1: Beginning at the Southwest corner of Section 36, Township 34 South, Range 12 West, Salt Lake Base and Meridian; running thence North 00°25'02" East along the West line of the Southwest quarter said Section 36, 1401.22 feet to a point in the centerline of a proposed 66.00 foot roadway easement; thence departing said West line running North 87°43'44" East along said centerline easement 660.58 feet to a point in the intersection of a proposed 66.00 foot roadway; thence departing said centerline running South 00°16'45" West 1397.30 feet to a point on the South line of the Southwest quarter said Section 36; thence South 87°24'19" West along said South line 664.14 feet to the point of beginning. Excepting therefrom 50% of all oil, gas and/or other minerals in, on or under said land, together with the right of ingress and egress for the purpose of exploring and/or removing the same. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
