NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States of America at the time and in the manner set forth below, such public auction to be held near the Scott M. Matheson statue inside the rotunda at the East entrance of the Scott M. Matheson Courthouse, located at 450 South State Street, Salt Lake City, Utah, on January 21, 2013, at the hour of 9:00 a.m.. (local time), for the purpose of foreclosing that certain Deed of Trust, executed by CROSSWAY GROUP, LLC, a Utah limited liability company, as trustor, for the benefit of Business Loan Center, LLC, as original beneficiary and recorded on August 15, 2006, in the official records of Salt Lake County, Utah as Entry No. 9812328, in Book 9336, beginning on page 188, (the "Deed of Trust"). The beneficial interest in the Deed of Trust was subsequently assigned to Brad Hall & Associates, Inc. ("Beneficiary"). The Deed of Trust describes and encumbers real property located in the County of Salt Lake, State of Utah, and more particularly described as: Part of Lot 4, Block 57, Plat "B", Salt Lake City Survey; commencing a the Southwest corner of said Lot 4, and running thence East 82.5 feet; thence North 100 feet; thence West 82.5 feet; thence South 100 feet to the point of beginning. Also: Commencing 44.95 feet West from the Southeast corner of Lot 4, Block 57, Plat "B", Salt Lake City Survey; thence North 165 feet; thence West 37.55 feet; thence South 165 feet; thence East 37.55 feet to the point of beginning. Less and Excepting: Commencing 44.95 feet West and 100.00 feet North from the Southeast Corner of Lot 4, Block 57, Plat "B", Salt Lake City Survey; thence North 65.00 feet; thence West 37.55 feet; thence South 65.00 feet; thence East 37.55 feet to the point of beginning. The following is shown for information purposed only: 16-05-127-033 The current trustee, DAVID E. LETA, ESQ. ("Trustee") disclaims any responsibility for any error in the description of the physical address or legal description of the property. The sale of the property described herein will be made without any warranty, including warranties as to title, possession, encumbrances or bankruptcy status. Bidders must be prepared to tender $5,000.00 in certified funds at the sale and the balance of the purchase price in certified funds within twenty-four (24) hours of the sale (unless the following day is a weekend or holiday in which case the balance must be tendered on the next business day following the day of the sale). The sale is also subject to a workout, reinstatement, payoff, sale cancellation or postponement, incorrect bidding instructions, bankruptcy, or any other circumstance of which the Trustee is unaware. In the event any of the foregoing apply, the sale will be void and the successful bidder's funds will be returned without any liability to the Trustee or Beneficiary for interest or any other damages.
