Notice of Trustee's Sale The following property will be sold at public auction to the highest bidder without warranty, at the main entrance of the Second District Court Building, 2525 Grant Avenue, Ogden, Utah, on 2/11/13 at 11:30 AM, for the purpose of foreclosing a Trust Deed executed by Troy A. Luke and Kaylie K. Luke, as Trustors, in favor of Mortgage Electronic Registration Systems, Inc. as nominee for Provident Funding Associates, L.P., its successors and assigns, recorded on 8/7/07, as Entry # 2283171, covering real property purportedly known as 738 West 4300 South, Riverdale, UT 84405, and more particularly described as: Part of Lots 88 and 89, RIVER VALLEY SUBDIVISION NO. 3, Riverdale City, Weber County, Utah, described as follows: Beginning at the Southwest corner of said Lot 88; running thence North 0°02`54" West 119.41 feet; thence North 84°34`15" East 67.50 feet; thence South 5°26`02" East 114.26 feet to the Southeast corner of said Lot 88; thence Westerly along a curve to the right 78.90 feet to the point of beginning. TAX # 06-009-0002. Provident Funding Associates, L.P. is the current Beneficiary of the Trust Deed. Record owners of the property as of the recording of the Notice of Default are reported to be Troy A. Luke and Kaylie K. Luke. Highest bidder must tender to Trustee a $20,000 deposit in certified funds/cashier's check at time of sale. Deposit is non-refundable and retained as damages if balance not paid within 24 hours of sale. Trustee disclaims liability for any error in the street address shown herein. Trustee may void sale due to any unknown facts at time of sale that would cause the cancellation of the sale. If sale is voided, Trustee shall return funds to bidder, and the Trustee and Beneficiary shall not be liable to bidder for any damages.
