Notice of Trustee's Sale The following property will be sold at public auction to the highest bidder without warranty, at the South Main Entrance, Fourth Judicial District, American Fork Division, 75 East 80 North, American Fork, Utah, on 7/30/13 at 08:30 AM, for the purpose of foreclosing a Trust Deed executed by Tim Beacham and Camille Wilke, as Trustors, in favor of Mortgage Electronic Registration Systems, Inc. as nominee for Stearns Lending, Inc., its successors and assigns, recorded on 8/31/09, as Entry # 95197:2009, covering real property purportedly known as 152 North 130 East, Orem, UT 84058, and more particularly described as: Unit No. 2, Phase VI, contained within the EASTVIEW CONDOMINIUMS, as the same is identified in the Record of Survey Map recorded in Utah County, Utah, as Entry No. 19667 and Map Filing No. 4911, and in the Declaration of Covenants, Conditions and Restrictions and Bylaws of the EASTVIEW CONDOMINIUMS, recorded in Utah County as Entry No. 15441, in Book 2690, at Page 75, and in the Amended Declaration of Covenants, Conditions, Restrictions and Bylaws of the EASTVIEW CONDOMINIUMS, recorded in Utah County, Utah, as Entry No 38421, in Book 3142, at Page 367 of the Official Records. Together with: (A) The undivided ownership interest in said condominium project`s common areas and facilities which is appurtenant to said Unit, (the referenced Declaration of Condominium providing for periodic alteration both in the magnitude of said undivided ownership interest and in the composition of the common areas and facilities to which said interest relates); (B) The exclusive right to use and enjoy each of the limited common areas which is appurtenant to said Unit, and (C) The non-exclusive right to use and enjoy the common areas and facilities included in said condominium project (as said project may hereafter be expanded) in accordance with the aforesaid Declaration and Survey Map (as said Declaration and Map may hereafter be amended or supplemented) and the Utah Condominium Ownership Act. SAID PROPERTY IS MORE CORRECTLY DESCRIBED AS: Unit No. 2, Phase VI, contained within the EASTVIEW CONDOMINIUMS, as the same is identified in the Record of Survey Map recorded in Utah County, Utah, as Entry No. 19667 and Map Filing No. 4911, and in the Declaration of Covenants, Conditions and Restrictions and Bylaws of the EASTVIEW CONDOMINIUMS, recorded in Utah County as Entry No. 15441, in Book 2690, at Page 75, and in the Amended Declaration of Covenants, Conditions, Restrictions and Bylaws of the EASTVIEW CONDOMINIUMS, recorded in Utah County, Utah, as Entry No 28421, in Book 3142, at Page 367 of the Official Records. Together with: (A) The undivided ownership interest in said condominium project`s common areas and facilities which is appurtenant to said Unit, (the referenced Declaration of Condominium providing for periodic alteration both in the magnitude of said undivided ownership interest and in the composition of the common areas and facilities to which said interest relates); (B) The exclusive right to use and enjoy each of the limited common areas which is appurtenant to said Unit, and (C) The non-exclusive right to use and enjoy the common areas and facilities included in said condominium project (as said project may hereafter be expanded) in accordance with the aforesaid Declaration and Survey Map (as said Declaration and Map may hereafter be amended or supplemented) and the Utah Condominium Ownership Act. TAX # 38:158:0002. Nationstar Mortgage LLC is the current Beneficiary of the Trust Deed. Record owners of the property as of the recording of the Notice of Default are reported to be Tim Beacham and Camille Wilke. Highest bidder must tender to Trustee a $20,000 deposit in certified funds/cashier's check at time of sale. Deposit is non-refundable and retained as damages if balance not paid within 24 hours of sale. Trustee disclaims liability for any error in the street address shown herein. Trustee may void sale due to any unknown facts at time of sale that would cause the cancellation of the sale. If sale is voided, Trustee shall return funds to bidder, and the Trustee and Beneficiary shall not be liable to bidder for any damages.
