AMENDED NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the South Entrance, Cedar City Hall of Justice, 40 North 100 East, Cedar City, Utah, on February 19, 2013, at 12:00 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on December 24, 2007 by Brent E. Drew and Evelyn C. Drew, as trustors, in favor of Washington Mutual Bank, FA, covering the following real property purported to be located in Iron County at 499 West 3600 North, Cedar City, UT 84720 nka Enoch, UT 84721 (the undersigned disclaims liability for any error in the address), and more particularly described as: Lots 15 and 16, PIONEER VALLEY ESTATES, according to the official plat thereof on file and of record in the Iron County Recorder's Office. Excepting therefrom the following; beginning at the Northeast corner of Lot 1, PIONEER VALLEY ESTATES, a subdivision, according to the official plat thereof on file in the office of the county recorder of said county, and running thence North 89 deg. 30'15" East 53.50 feet; thence South 0 deg. 21'56" West 80.00 feet; thence North 89 deg. 830'15" West 20.0 feet to the point of beginning. Together with 2.0 acre feet of underground water from PIONEER VALLEY ESTATES well, Application No. A-6602. More Correctly Described As: All of Lots 15 and 16, PIONEER VALLEY ESTATES, A SUBDIVISION, according to the official plat thereof on file in the office of the Iron County Recorder, State of Utah. Excepting therefrom the following: beginning at the Northeast corner of Lot 1, PIONEER VALLEY ESTATES, A SUBDIVISION, according to the official plat thereof on file in the office of the County Recorder of said County, and running thence North 89°30'15" West 33.50 feet; thence North 0°21'56" East 80.00 feet; thence South 89°30'15" East 53.50 feet; thence South 0°21'56" West 80.00 feet; thence North 89°30'15" West 20.0 feet to the point of beginning. Together with 2.0 acre feet of underground water from PIONEER VALLEY ESTATES well, Application No. A-6602. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: A-0882-0012-0000 The current beneficiary of the trust deed is JPMorgan Chase Bank, National Association and the record owners of the property as of the recording of the notice of default are Brent E. Drew and Evelyn C. Drew. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
