NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the West Main Entrance, Millard County Court Complex, 765 South Highway 99, Fillmore, Utah, on May 14, 2013, at 12:00 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on August 17, 2006 by Eben R. Leatham and Crystal Leatham, as trustors, in favor of Nationstar Mortgage LLC F/K/A Centex Home Equity Company, LLC, covering the following real property purported to be located in Millard County at 90 South 200 West, Fillmore, UT 84631 (the undersigned disclaims liability for any error in the address), and more particularly described as: Beginning at the Southeast Corner of Lot 1, Block 60, Plat A, Fillmore City Survey, thence West 109 feet, thence North 10 rods; thence East 109 feet; thence South 10 rods to the point of the beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 0175746 F 296-2 The current beneficiary of the trust deed is Nationstar Mortgage, LLC and the record owners of the property as of the recording of the notice of default are Eben R. Leatham and Crystal Leatham. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
