NOTICE OF TRUSTEE'S SALE The following property will be sold to the highest bidder at a public auction at the South entrance of the Fourth District Judicial Center, 75 East 80 North, American Fork, Utah, on May 13, 2013, at 9:00 a.m., to foreclose a Trust Deed recorded December 26, 2002 as Entry No. 155811:2002, executed by Cody Heward and Kim Heward, as Trustors, in favor of Mortgage Electronic Registration Systems, Inc. as nominee for Fieldstone Mortgage Company and its successors and assigns, covering real property in Utah County (Tax/Parcel No. 21-043-0070) purportedly, but not guaranteed to be located at 741 S. 1100 W., Provo, Utah 84601, together with, and subject to, any applicable improvements, fixtures, easements, appurtenances, taxes, assessments, conditions, covenants, restrictions, reservations or other enforceable rights and obligations, and described as follows: COMMENCING AT A CHAIN LINK FENCE CORNER LOCATED ON THE EAST SIDE OF 1100 WEST STREET, PROVO, UTAH, WHICH IS SOUTH 163.17 FEET AND WEST 677.27 FEET FROM THE EAST QUARTER CORNER OF SECTION 11, TOWNSHIP 7 SOUTH, RANGE 2 EAST, SALT LAKE BASE AND MERIDIAN; THENCE ALONG THE EXISTING CHAIN LINK FENCES AS FOLLOWS: SOUTH 89°22'01" EAST 245.65 FEET; THENCE SOUTH 00°35'09" WEST 41.50 FEET; THENCE SOUTH 88°24'33" WEST 38.98 FEET; THENCE SOUTH 71°12'56" WEST 40.39 FEET; THENCE SOUTH 55°00'21" WEST 28.08 FEET; THENCE NORTH 89°26'48" WEST 145.58 FEET, THENCE NORTH 00°22'45" EAST 73.00 FEET TO THE POINT OF BEGINNING. SUBJECT TO A BOUNDARY LINE AGREEMENT RECORDED NOVEMBER 2, 1984, AS ENTRY NO. 32415, IN BOOK 2174, AT PAGE 562, UTAH COUNTY RECORDER'S OFFICE. The current beneficiary of the Trust Deed is HSBC Mortgage Services Inc. and as of the date the Notice of Default recorded, the property was owned by Cody Heward and Kim Heward according to record. The successful bidder must tender a $10,000 non-refundable deposit at the sale, in the form of a cashier's check payable to the Trustee, and deliver the balance in certified funds to the Trustee's office within 24 hours of the sale; otherwise, the Trustee reserves the right to sell the property to the next highest bidder, retain the deposit, and hold the defaulting bidder liable for any additional damages. The sale is without any warranty, including title, possession and encumbrance, and is voidable by the Trustee, without any liability, for any circumstance unknown to the Trustee affecting the validity of the sale. If the Trustee voids the sale, the successful bidder's sole remedy is return of any funds tendered to the Trustee.
