NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the Main Entrance, Cache County District Court 135 North 100 West, Logan, Utah, on April 25, 2013 at 1:00 PM, for the purpose of foreclosing a Trust Deed dated July 16, 2004 executed by Marcia S Macare, as Trustor, in favor of Mortgage Electronic Registration Systems, Inc., as Beneficiary, covering real property located in Cache County and described as follows: BEGINNING AT A POINT 4.5 RODS NORTH OF THE SOUTHEAST CORNER OF LOT 1, BLOCK 10, PLAT "A" LOGAN CITY SURVEY, AND RUNNING THENCE WEST 72 FEET; THENCE NORTH 4.5 RODS; THENCE EAST 72 FEET TO A POINT DUE NORTH OF THE POINT OF BEGINNING; THENCE SOUTH 4.5 RODS TO THE POINT OF BEGINNING, AND FURTHER DESCRIBED AS BEING SITUATE IN THE SOUTHWEST QUARTER OF SECTION 33, TOWNSHIP 12 NORTH , RANGE 1 EAST OF THE SALT LAKE BASE AND MERIDIAN. TOGETHER WITH AN EASEMENT TO CONSTRUCT AND MAINTAIN A SEWER LINE FOR THE BUILDING ON THE SAID PROPERTY ACROSS THE REMAINING LOT OF THE GRANTORS, BEING THE SOUTH 4.5 RODS OF THE EAST 72 FEET OF SAID LOT 1, SAID SEWER TO BE CONSTRUCTED WEST OF THE HOME OF THE GRANTORS ON THE LAST DESCRIBED PROPERTY. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Tax Parcel No.: 06-008-0002 The street address of the property is purported to be 21 North 400 West, Logan, UT 84321. The undersigned disclaims any liability for any error in the street address. The current Beneficiary of the trust deed is The Bank of New York Mellon FKA the Bank of New York, as Trustee (CWALT 2004-22CB) and the record owners of the property as of the recording of this notice of default is reported to be Marcia S Macare. Bidders must be prepared to tender to the trustee $10,000.00 in the form of a cashier's check or money order(s) at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The balance may be in the form of a cashier's check, money order(s), or wire transfer. Cash and bank official checks are not acceptable. A trustee's deed will be made available to the successful bidder within three business days following receipt of the bid amount. Receipt of the bid amount being defined as the date tendered funds "clear" the trustee's trust account. The sale is made without any warranty whatsoever, including but not limited to any warranty as to title, liens, possession, taxes, encumbrances, or condition of the property. The sale is subject to a workout reinstatement, payoff, sale cancellation or postponement, incorrect bidding instructions, bankruptcy, or any other circumstance of which the trustee is unaware. In the event any of the foregoing apply, the sale will be void and the successful bidder's funds will be returned without any liability to the trustee or beneficiary for interest or any other damages.
